Shield Subscription Terms

These Shield Subscription Terms ("Subscription Terms") govern your subscription to and use of the ClawOps Shield scanner service ("Shield"). These Subscription Terms supplement and are incorporated into the ClawOps Terms of Service. In the event of a conflict between these Subscription Terms and the general Terms of Service, these Subscription Terms control with respect to the Shield service.

1. Subscription Plans and Features

1.1 Available Plans

Shield is offered at the following subscription tiers:

1.2 Scan Limit Resets

For the Starter plan, scan allowances reset on the monthly anniversary of your subscription start date. Unused scans do not roll over to the next billing period.

1.3 Plan Changes

You may upgrade or downgrade your subscription plan at any time through the Stripe customer portal or by contacting us at contact@theclawops.com. Upgrades take effect immediately. Downgrades take effect at the start of the next billing cycle.

2. Auto-Renewal and Billing

2.1 Billing Cycle

All paid Shield plans are billed monthly. Your billing cycle begins on the date you first subscribe and renews on the same date each month.

2.2 Payment Processing

Payments are processed through Stripe. By subscribing, you agree to Stripe's terms of service and authorize recurring charges to your designated payment method.

2.3 Price Changes

We may change subscription prices with at least 30 days' advance notice. Price changes take effect at the start of your next billing cycle after the notice period. Continued use of Shield after a price change constitutes acceptance of the new pricing.

2.4 Failed Payments

If a renewal payment fails, we may retry the charge and/or suspend your access to paid features until payment is successfully processed. We will notify you by email of any payment failure.

3. Cancellation

3.1 How to Cancel

You may cancel your Shield subscription at any time using either of these methods:

• Stripe Customer Portal: Access your subscription management page through Stripe to cancel directly.
• Email: Send a cancellation request to contact@theclawops.com. We will process your request within two (2) business days.

3.2 Effect of Cancellation

When you cancel:

• Your subscription remains active until the end of the current paid billing period.
• You will not be charged for subsequent billing periods.
• After the current period ends, your account reverts to the Free tier (1 scan, no account required).
• Scan history and reports may be deleted 30 days after your paid subscription ends.

3.3 No Cancellation Fees

There are no cancellation fees or penalties for canceling your subscription.

4. Refund Policy

4.1 Seven-Day Refund Window

If you cancel within seven (7) days of your initial subscription purchase or a renewal charge, you are eligible for a pro-rated refund for the unused portion of that billing period.

4.2 After Seven Days

After seven (7) days from any charge, no refunds will be issued for that billing period. You will retain access to paid features through the end of the current billing cycle.

4.3 How to Request a Refund

To request a refund, email contact@theclawops.com with your account email and the reason for your request. Refunds are processed within five (5) business days to your original payment method.

5. Scanner Accuracy Disclaimers

5.1 Detection Method

Shield uses rule-based pattern matching and heuristic analysis to detect potential prompt injection, data exfiltration, social engineering, and other threat patterns. It does not use comprehensive static analysis, dynamic analysis, or formal verification methods.

5.2 Informational Only

All scan results are provided for informational purposes only. Shield is designed to assist you in identifying potential risks, not to provide a definitive security assessment.

5.3 False Positives and False Negatives

Scan results may include:

• False positives: Flagging content as potentially malicious when it is not.
• False negatives: Failing to detect content that is actually malicious.

A clean scan does not guarantee that a file is free from malicious content or security vulnerabilities.

5.4 Not a Substitute for Professional Security Audits

Shield is not a substitute for professional security audits, penetration testing, or comprehensive security assessments. For critical or high-risk environments, you should engage qualified security professionals.

5.5 Client-Side Scanning

Scans run entirely in your browser. Your files are not uploaded to or stored on ClawOps servers. While this protects your data privacy, it also means scan capabilities are limited to client-side pattern matching.

6. Limitation of Liability

6.1 Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLAWOPS' TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO YOUR USE OF SHIELD SHALL NOT EXCEED THE TOTAL SUBSCRIPTION FEES YOU PAID TO CLAWOPS FOR SHIELD IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

6.2 Exclusion of Damages

IN NO EVENT SHALL CLAWOPS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE SHIELD, INCLUDING BUT NOT LIMITED TO:

• Damages resulting from reliance on scan results (whether false positives or false negatives)
• Security breaches or incidents that Shield failed to detect
• Loss of data, revenue, or business opportunities
• Cost of substitute security services

6.3 Disclaimer of Warranties

SHIELD IS PROVIDED "AS IS" AND "AS AVAILABLE." CLAWOPS MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR FITNESS FOR A PARTICULAR PURPOSE OF SHIELD OR ITS SCAN RESULTS.

7. California Auto-Renewal Compliance (SB-313)

• Automatic Renewal: Your Shield subscription will automatically renew on a monthly basis at the rate stated at the time of purchase, unless you cancel before the renewal date.
• Cancellation Policy: You may cancel at any time via the Stripe customer portal or by emailing contact@theclawops.com. Cancellation takes effect at the end of the current billing period.
• Consent: By subscribing to a paid Shield plan, you provide your affirmative consent to the automatic renewal terms described herein.
• Confirmation: You will receive a confirmation of your subscription via email at the email address associated with your account. This confirmation will include the subscription terms, pricing, and cancellation instructions.
• Renewal Reminders: We will send a renewal reminder to your email address at least 3 days before each renewal charge.

8. Acceptable Use

Your use of Shield is subject to the ClawOps Acceptable Use Policy. In addition to the general AUP, you agree to the following Shield-specific rules:

• You may only scan files you own or have authorization to scan.
• You must not use the scanner to identify vulnerabilities for the purpose of exploitation.
• Automated or bot-driven scanning that exceeds your plan limits is prohibited.
• Reverse engineering, extracting, or replicating Shield's detection rules or patterns is prohibited.

9. Changes to These Terms

ClawOps may update these Subscription Terms at any time. We will notify you of material changes by email and by updating the "Last Updated" date above. Continued use of Shield after changes take effect constitutes acceptance of the updated Subscription Terms. If you do not agree to the changes, you may cancel your subscription.
